Terms of Service for ReConstruct

Welcome to ReConstruct, an app developed and operated by Precog Visuals, LLC ("Precog Visuals," "we," "us," or "our"). By accessing or using the ReConstruct app ("Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.

You must be at least 13 years old to use the Services. By accessing or using the Services, you represent and warrant that you meet this age requirement and have the capacity to enter into a binding agreement.

• To use certain features of the Services, you must create an account by providing your name, email address, and a secure password.
• By creating an account, you agree to our Privacy Policy.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

ReConstruct allows users to:

• Upload or take photographs of home or building interiors and exteriors.
• Use AI tools to apply design styles and reimagine spaces.

The app provides 2 free image generations before you are required to choose a subscription plan.

Precog Visuals does not guarantee the accuracy, reliability, or suitability of AI-generated results. The Services are intended for conceptual and inspirational purposes only.

• Ownership: You retain ownership of images you upload to the Services ("User Content").
• Licensing: By uploading User Content, you grant Precog Visuals and its affiliates a nonexclusive, worldwide, royalty-free, fully paid, transferable, sublicensable, perpetual, irrevocable license to copy, display, upload, perform, distribute, store, modify, and otherwise use User Content for the purpose of operating, improving, and developing the Services and any affiliate services.
• Representation: You represent and warrant that you own or have rights to all User Content, including copyrights and rights of publicity, and that your content does not violate any applicable laws or third-party rights.

• User account data (name, email, password) is securely stored using Firebase, which is a secure method to the best of our knowledge.
• Uploaded images and AI-generated outputs may be temporarily stored in the cloud as part of the processing event but are not retained by Precog Visuals after processing.

• The Services allow for a limited number of free trials. Continued use requires either a paid subscription or individual purchases.
• All fees are non-refundable.

You agree not to:

• Upload content that is illegal, offensive, defamatory, or infringes on third-party rights.
• Attempt to reverse-engineer, modify, or disrupt the Services.

Precog Visuals reserves the right to remove content or terminate accounts for violations of these Terms.

Precog Visuals is not liable for:

• Any damages resulting from the use or inability to use the Services.
• Inaccuracies or errors in AI-generated results.

You use the Services at your own risk.

The Services are provided "as is" and "as available." We make no warranties, express or implied, regarding the Services, including their reliability, accuracy, or suitability for your purposes.

We may suspend or terminate your account at any time for:

• Violations of these Terms.
• Non-payment.
• Any reason at our sole discretion.

• Governing Law: These Terms are governed by the laws of the State of California.
• Arbitration: Any disputes arising from or related to these Terms or the Services will be resolved through binding arbitration in Los Angeles, California, in accordance with the rules of the American Arbitration Association.
• Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in a class-action lawsuit.

Precog Visuals reserves the right to modify these Terms at any time. Significant changes will be communicated via email. Continued use of the Services constitutes acceptance of the updated Terms.
